1. Acceptance of Terms

By registering, accessing, browsing, or utilizing the PushNova Web Console, REST/WebSocket APIs, Android client, or any relay services provided by PushNova ("we", "us", or "our"), you ("user", "customer") agree to be legally bound by these Terms of Service and our Privacy Policy. If you are entering into these terms on behalf of a company or legal entity, you warrant that you have the requisite authority to bind that entity.

If you do not agree with any part of these Terms, you must immediately refrain from accessing or using PushNova.

2. Service Architecture & Use Regulations

PushNova is an enterprise serverless push notification and device fleet governance gateway deployed across a global edge network and distributed cloud storage:

• Web Console: Used for visual fleet administration, drag-and-drop Kanban grouping, topic orchestration, HMAC key rotation, human-in-the-loop (HITL) approvals, and billing ledger audits.
• APIs & Quota Limits: Push limits and dispatch frequency thresholds are allocated based on your subscribed tier. Attempting to bypass limits via high-concurrency flooding, signature spoofing, or vulnerability exploitation is strictly prohibited.
• Android Client: PushNova distributes an official Android client package featuring client-side P-256 ECIES end-to-end decryption backed by Android Keystore. You are granted a personal, non-exclusive, non-transferable license to run the APK. Reverse engineering, decompiling, or re-signing malicious variants is strictly forbidden.

3. Fees, Billing, Payments & Strict No-Refund Policy

PushNova offers PRO membership buyouts/subscriptions and on-demand Booster message quota packages:

• Merchant of Record (MoR): All online checkout transactions and merchant billing are processed and securely hosted by Creem (Creem.io) as our official Merchant of Record. PushNova does not collect, process, or store raw credit card numbers or security codes (CVV).
• Strict No-Refund Policy: Because digital software rights, cloud bandwidth, and database quota allocations are fulfilled instantly upon receipt of payment confirmation, all transactions are strictly non-refundable. PushNova does not offer free refunds, money-back guarantees, or partial refunds for unused quotas.
• Try Before You Buy: Every newly registered account is provided with a 30-day trial with 10,000 complimentary push notifications. You are encouraged to thoroughly test deliverability, channel stability, and hardware compatibility during this trial period before committing to a paid tier.
• Technical Billing Discrepancies: If a verifiable technical glitch causes duplicate billing or fails to deliver quotas within 24 hours of successful payment, you must contact our support within 7 calendar days with your Creem Checkout Session ID for review and manual quota reconciliation.

4. Acceptable Use Policy (AUP)

PushNova enforces a strict, zero-tolerance policy against network abuse and unlawful activity. You agree not to use PushNova to:

• Transmit unsolicited bulk messages (Spam), phishing scams, fraudulent financial schemes, or harassing communications;
• Distribute trojans, ransomware, spyware, or malicious binary payloads;
• Facilitate money laundering, cyber extortion, terrorism, or copyright infringement;
• Conduct vulnerability scans, denial-of-service (DDoS) attacks, or disrupt the operation of PushNova gateway clusters and API endpoints.

Enforcement: Any account in breach of this AUP is subject to immediate, permanent termination without prior notice. Terminated accounts forfeit all remaining message quotas and are strictly ineligible for any refund. We cooperate fully with law enforcement authorities in cases involving criminal conduct.

5. Intellectual Property Rights

All intellectual property rights, trademarks, service marks, console designs, UI elements, and software source code associated with PushNova remain the exclusive property of PushNova and its licensors. Unauthorized scraping, copying, framing, or unauthorized redistribution is prohibited.

6. Disclaimer of Warranties

PushNova is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain 99.9% uptime leveraging global edge and official push-channel infrastructure, we make no express or implied warranties regarding uninterrupted service, latency-free delivery, or fitness for a particular commercial purpose. PushNova shall not be held liable for delivery failures caused by cellular network dropouts, offline device states, or vendor push policy modifications.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PushNova be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data corruption, or business interruption). PushNova's total cumulative liability for any claim arising under these Terms shall not exceed the amount actually paid by you to PushNova during the three (3) months preceding the incident.

8. Amendments, Governing Law & Inquiries

We reserve the right to revise or update these Terms as necessary. Continued use of the platform after updates have been published signifies acceptance of the amended Terms.
